Federal Lawsuit Seeks To Enjoin False Marketing Of Hubble-Like Advanced Telescopes

NEW YORK, NY – November 6 – Fourteen distributors of telescopes and Meade Instruments Corp. have engaged in a scheme by which they falsely describe inexpensive telescopes produced by Meade as having the same advanced design as the Hubble Space telescope, according to a lawsuit filed in the U.S. District Court in New York.  The lawsuit seeks an injunction preventing Meade and the distributors from advertising inexpensive Meade telescopes as having an advanced “Ritchey-Chretien” design.  It was filed by three plaintiffs: an individual who purchased one of the controversial telescopes, an optics manufacturer and a rival telescope manufacturer.

Although the complaint seeks monetary damages, an attorney for the plaintiffs confirmed that the plaintiffs have extended offers to the distributors to resolve the case without financial compensation, provided that the distributors cease describing the controversial telescopes as “Ritchey-Chretien” immediately.  An attorney for the Plaintiffs, Russell K. Statman, stated: “Amateur astronomy enthusiasts have a right to know what type of telescope they are being offered.  They have a right to know the integrity of the images displayed by their telescopes.  We just want them to be told the truth.”

Copies of the amended complaint are available online at http://ecf.nysd.uscourts.gov.  The case is Azari et al. v. B&HPHoto-Video.com Corp., no 06 CIV 7825.  The Plaintiffs’ attorney is Russell K. Statman, Esq., (212) 528-8629, e-mail: rks@country-lawyer.net.
